Module Outline
Canadian administrative law is the body of law that regulates the relationship between the government and individuals, ensuring that governmental action is fair and reasonable. It provides a framework for how government bodies and administrative tribunals make decisions and act and ensures that they operate within the boundaries of their authority and respecting the rights of those affected by their actions and decision-making. Administrative law acts as a check on governmental power, to ensure that it is authorised by Parliament and/or the provincial legislatures, and that it is exercised responsibly, transparently and in accordance with the law.
Module learning outcomes
Explain the role of the administrative state
Determine what types of governmental actions/decisions may be subject to judicial review and the different stakeholders that may be affected
Identify the remedies available on judicial review.
Evaluate governmental actions/decisions for substantive and procedural fairness.
